Key takeaways
  • A landlord who does not return the deposit or apply for dispute resolution within 15 days can be ordered to pay double the deposit.
  • Skipping the move-out condition inspection can cost either side rights over the deposit.
  • Give your forwarding address in writing, because without it your right to the deposit can end after one year.

Moving out is stressful enough without a bill for cleaning or repairs. Many tenants in British Columbia worry that the landlord will simply keep part of the deposit, and many landlords wonder what they are allowed to claim.

The answer turns on what is actually damage, whether the move-out inspection was done properly, and what the landlord does with the deposit afterwards. This article walks through each step in plain language.

This article covers the law of British Columbia.

Damage versus normal wear and tear

Deposit disputes often turn on the difference between damage and the ordinary ageing of a home from everyday living. Whether something is one or the other depends on the facts, such as the age of the item and how it was used, so it is worth confirming with a lawyer if the amount is significant.

Photos and the written inspection reports from move-in and move-out are the best evidence of what changed. If your pet caused damage, the pet damage deposit covers it unless the parties agree otherwise in writing or an arbitrator orders otherwise. If that deposit does not cover the damage, a landlord can ask for an order for the tenant to pay additional costs.

Why the move-out inspection matters

A tenant who does not take part in the move-out condition inspection when the landlord asks may lose the right to have the deposit returned. A landlord who skips inspection duties can lose the right to claim against the deposit.

In practice, that means you should attend, walk through the unit with the landlord, and read the report carefully before signing. If you disagree with something, say so and note it in writing.

What happens to the deposit after you leave

Within 15 days after the later of the end of the tenancy or the date the landlord receives your forwarding address in writing, the landlord must repay the deposit with interest or apply for dispute resolution to claim against it. If the landlord does not, the landlord may not claim against the deposit and must pay the tenant double the deposit.

If the landlord takes no action in 15 days, the tenant can make a direct request application, and the landlord may be ordered to pay double. Interest may be owed on the deposit, and the Province lists the rate as 0% for 2026, 0.95% for 2025, 2.7% for 2024 and 1.95% for 2023. The landlord must calculate that interest before returning the deposit or applying for deductions.

Charges a landlord cannot add

Landlords cannot charge a fee for returning the deposit, and they cannot charge a monthly pet fee beyond the pet damage deposit. They also cannot charge a fee for accepting, reviewing or processing a rental application. A security deposit is capped at half of one month's rent. If you overpaid a deposit, you can withhold the difference from your next rent but must tell the landlord in writing.

Only one security deposit and one pet deposit may be taken. The pet damage deposit is capped at half of one month's rent, regardless of the number of pets. Certified guide and service dogs are not pets, so a landlord cannot charge a pet damage deposit for them.

What to do next

The filing fee for most dispute resolution applications is set at $100, though some applications may differ. An arbitrator's decision must be given promptly and in any event within 30 days after the proceedings conclude, and it is final and binding on the parties, except as otherwise provided.

Frequently asked questions

Can my landlord keep my deposit for cleaning?

Whether a particular cleaning charge is justified depends on the facts, including the condition of the unit, so it is worth confirming with a lawyer. What the rules do set is a process: the landlord must repay the deposit or apply for dispute resolution within 15 days after the later of the tenancy's end or the date the landlord receives your forwarding address in writing.

What if I never gave a forwarding address?

If you do not give one within one year after the tenancy ends, the landlord may keep the deposit and your right to it ends. Give it in writing as soon as you move.

Can a landlord charge a fee for returning my deposit?

No. Landlords cannot charge a fee for returning the deposit.

What if the landlord misses the 15 days?

The landlord may not claim against the deposit and must pay you double the deposit. You can make a direct request application if nothing happens.
