What is a humanitarian and compassionate application for permanent residence?

A Humanitarian and Compassionate (H&C) application is a federal discretionary pathway that allows people who do not fit a standard immigration program to request permanent residence based on their specific circumstances. It is not a backup to a refused application in the same way an appeal is — it is a distinct application that asks IRCC to exercise discretion.

IRCC considers factors such as how established you are in Canada, the best interests of any children involved, conditions in your country of origin, and other hardship you would face if required to leave Canada and apply through normal channels abroad. H&C applications are assessed holistically — no single factor is determinative.

An H&C application does not automatically stay a removal order, though an active H&C application can sometimes be considered in enforcement decisions. Processing times for H&C applications tend to be lengthy. These applications have a lower success rate than program-specific applications and are genuinely meant for exceptional circumstances, not as a general alternative to meeting program requirements. Given the discretionary nature and complexity, an H&C application is one area where working with a lawyer is strongly advisable.
