Can I stay in the family home after separation in Manitoba?

TSL Written by the Treadstone Law Team· Updated November 6, 2026

This answer covers the law of Manitoba.

Possibly, and being left off the title does not necessarily take away your rights. In Manitoba, homestead rights apply to married persons and to common-law partners, whether or not the non-owner is on title. Who counts as a common-law partner can differ between statutes. Separated spouses also remain legally married until a divorce.

Under The Homesteads Act, an owner generally cannot dispose of the homestead without the spouse's or common-law partner's written consent, unless that spouse has released their rights in writing for valuable consideration. A spouse with homestead rights may register a homestead notice in the land titles office, which blocks registration of a disposition until the notice is vacated or discharged. A city, town or village residence the owner and spouse occupy as their home is included.

These rights limit what an owner can do with the home. They do not, on their own, settle who lives there day to day after separation, which depends on your circumstances. The home is usually a family asset, and family assets are generally split into two equal shares unless equalization would be grossly unfair or unconscionable. If safety is a concern, a protection order may include removal of the respondent from the residence. A lawyer can confirm how this applies to you.
