What does the Tarion warranty actually cover and for how long?
Tarion administers the mandatory new-home warranty in Ontario under the New Home Warranties Plan Act. The coverage is divided into several periods, each covering different types of defects.
The first 30 days after possession cover unauthorized substitutions, missing items promised in the agreement, and various deficiencies — essentially anything that should have been fixed at or before PDI. The first year covers defects in workmanship and materials (with some exclusions). The second year covers defects in the building envelope (the outer shell that keeps water and weather out) and mechanical, electrical, and plumbing systems. Seven-year coverage applies to major structural defects, meaning defects in load-bearing elements that pose a risk of structural failure.
There are financial caps on warranty coverage that Tarion adjusts periodically. Coverage does not include owner abuse, normal wear and tear, or issues caused by the owner's own renovations or neglect.
To use the warranty, you must submit your claim to Tarion within the applicable time window. You can submit online through the MyHome portal. If the builder disputes your claim or fails to respond, Tarion steps in to assess and potentially fund the repair.
