Is there a deadline to file a warranty claim with Tarion after I find a defect?

Yes, Tarion warranty claims must be filed within the applicable warranty period for the type of defect. Missing the deadline can result in losing your right to make a warranty claim, so timing is critical.

The one-year warranty for workmanship and materials requires you to submit your claim within the first year of possession. Tarion recommends that buyers complete a Year-End warranty form before the end of year one to capture any outstanding issues. Similarly, the two-year building envelope and mechanical systems warranty requires claims to be submitted within the two-year period. The seven-year major structural defect warranty runs from the original possession date.

For each of these periods, if you discover a defect near the end of the window, act immediately rather than waiting to see if the problem gets worse. Submit your claim through Tarion's MyHome portal as soon as you identify the issue, even if you are still documenting it.

There is also a first 30-day window for issues that should have been caught at PDI or that the builder promised to fix before possession. The dates are all calculated from the original possession date — for resale buyers, confirm that date with the seller so you know exactly how much coverage remains.
