What kinds of problems are NOT covered by the Tarion warranty?

While Tarion's warranty covers a broad range of new-home defects, there are important exclusions you should know before filing a claim.

Normal wear and tear is not covered — surfaces that deteriorate with ordinary use over time fall outside the warranty. Similarly, damage caused by the owner or their contractor through renovations, alterations, or improper maintenance is excluded. If you modify your new home and the modification causes or contributes to a defect, Tarion may deny coverage for related issues.

Items covered by a different warranty or insurance policy are generally excluded. For example, appliances covered by manufacturer warranties are not a Tarion responsibility. Weather damage to items that were not a builder defect, pest infestation, and cosmetic issues that do not affect function may also be excluded depending on circumstances.

Disputes about what is cosmetic versus a true defect can be contentious. Tarion applies defined standards set out in the Ontario Building Code and Tarion's own Construction Performance Guidelines — a document available on Tarion's website that specifies what constitutes a "defect" for each component of a home. Reviewing these guidelines before filing a claim helps you understand whether your issue is likely to qualify.
