Do I still owe spousal support if I am already paying child support?

TSL Written by the Treadstone Law team· Updated June 2026

Yes, it is possible to owe both child support and spousal support simultaneously. These are separate legal obligations and one does not eliminate the other. However, the fact that you are paying child support is directly relevant to how much spousal support you can afford to pay.

Under the Spousal Support Advisory Guidelines "with child support" formula, child support payments are taken into account when calculating spousal support. Because child support reduces the net disposable income you have available, the spousal support amount in the SSAG range may be lower than it would be without a child support obligation.

Courts also apply the practical test of ability to pay: they will not order combined support payments that leave a payor unable to meet their own reasonable living expenses. If the combined obligations are unmanageable, courts have the discretion to sequence or reduce the amounts, though child support generally takes priority because it is formula-based and less discretionary. If you are facing both obligations, a lawyer can calculate your total support exposure and advise on how the obligations interact.

Key takeaways

  • Child and spousal support are separate obligations but interact in the calculation.
  • The SSAG "with child support" formula reduces spousal support to account for child support payments.
  • Courts consider ability to pay — combined obligations must be realistic.
  • Child support generally takes priority over spousal support.
