How long does it take to finalize a separation agreement in Ontario?

The time to finalize a separation agreement in Ontario varies widely depending on how cooperative the parties are, how complex their finances are, and whether children are involved. At the shorter end, a relatively straightforward separation between cooperative parties who have already discussed the major issues can result in a signed agreement within a few weeks to a couple of months. At the longer end, complex cases involving business valuations, pensions, contested parenting arrangements, or significant conflict can take many months or longer.

The main steps are: exchanging financial disclosure, negotiating the terms (directly, through lawyers, or in mediation), drafting the agreement, each party reviewing it with their own lawyer, requesting revisions, and finally signing and witnessing the agreement.

Financial disclosure is often the step that causes the most delay. Both parties must provide complete information about income, assets, and debts. If one party is slow to provide documents or their financial situation is complicated (e.g., a business interest), disclosure can take months on its own.
