Do I need to register my business name as a sole proprietor in Ontario?

In Ontario, you only need to register a business name under the Business Names Act if you trade under a name that is different from your own legal name. If you operate as "Jane Smith Consulting," no registration is required. If you operate as "Apex Marketing Solutions," you must register that name with the Ontario Business Registry before using it.

Business name registration is not the same as incorporation. It puts the public on notice of who is behind the trade name, but it does not create a separate legal entity or give you limited liability. You remain personally responsible for all business obligations.

A registered business name in Ontario is valid for five years and must be renewed. Registration does not give you exclusive rights to the name across Canada or protect you from trademark infringement — those protections come from trademarks registered under the federal Trademarks Act.
